Terms & Conditions

These terms and conditions are the only ones the seller, Lawlor Press Brake Tooling Ltd (hereafter ‘LPT’) supply goods against. These terms and conditions prevail over any other conditions specified by the buyer in any documents supplied by the buyer unless agreed by both parties in writing.

Prices and technical specifications of goods shown in the ‘LPT’ catalogue or on the web-site are subject to change without prior notice

Ownership of the goods shall not pass to the buyer until full payment has been received for the goods supplied by ‘LPT’ as either cash or cleared funds.

Any cancellation of the contract by the buyer will not be accepted by ‘LPT’ unless it is with ‘LPT’s written consent and subject to the appropriate cancellation charge, set at 35% of the goods invoice value. Any goods ordered incorrectly will be subject to a 35% restocking fee.

Delivery times stated by ‘LPT’ represent an estimate only and shall not be made of the essence. ‘LPT’ shall not be made liable for any loss, whether direct, indirect or consequential resulting from a late delivery of goods being supplied, irrespective of the cause. Once delivered, goods cannot be returned without the prior written agreement of ‘LPT’

No claim for damage in transit will be accepted unless noted on the delivery note at the time of delivery and accompanied by a claim to the seller within three working days of receipt of the goods

Any photographs, illustrations or similar advertising material used by the seller represent the general product manufactured or sold by ‘LPT’ and shall not be taken as necessarily representing the goods supplied nor be taken as part of any contract.

The terms of payment are specified on the order acceptance and invoice – they are deemed accepted by the buyer on receipt of the buyer’s order

‘LPT’s total liability will not, in any circumstances, exceed the total amount of the price payable by the buyer.

‘LPT’ will not be liable (whether caused by our employees, agents or otherwise) in connection with the goods, for:

Any indirect, special or consequential loss, damage, costs or expenses; and/or
-
Any loss of profits; loss of anticipated profits; loss of business; loss of data; loss of reputation or goodwill; business interruption; or other third party claims; and/or
-
Any failure to perform any of our obligations if such delay or failure is due to any cause beyond our reasonable control; and/or
-
Any losses caused directly or indirectly by any failure or breach by the buyer in relation to the buyer’s obligations; and/or
-
Any loss relating to the choice of the goods and how they will meet the buyer’s purpose if not used as intended or recommended by ‘LPT’

The exclusions of liability contained within these terms & conditions will not exclude or limit ‘LPT’s liability for death or personal injury caused by our negligence; or for any matter for which it would be illegal for us to exclude or limit our liability; and for fraud or fraudulent misrepresentation.

This contract shall be governed by the Laws of England as a contract made in England and the Buyer hereby submits to the jurisdiction of the English Courts.
